1. Introduction

1.1. Terms & Conditions of this website (www.massagetables.co.za) and related mobi-sites and software applications (hereinafter referred to as the ‘Website’ is owned and operated by Wheco Group (Pty) Ltd (hereinafter referred to as ‘us’, ‘we’, ‘Massage Warehouse’, ‘Wheco Group’) a retailer of massage equipment.

1.2. The disclaimers, policies and terms and conditions hereinafter referred to as ‘Terms and Conditions’) shall govern the order, sale and/or delivery of goods or services from Massage Warehouse as well as the use of this website by any customer or person (herein after referred to as ‘you’, ‘your’, ‘user’, ‘customer’).

1.3. Please review the terms carefully. The Terms apply to all users of our website, including without limitation, users who are browsers, customers, merchants, vendors and/or contributors of content. If you access and use this website, you accept and agree to be bound by and comply with the Terms and Conditions. If you do not agree to the Terms and Conditions contained herein, you are not authorized to access our website, use any of our website’s services or place an order on our website.

1.4. Any personal information or data collected through the use of the website whether by communication, purchase invoicing or customer enquiry as well as in store transactions (governed by these terms & conditions) shall be utilised for the purposes of customer service, internal market research or direct marketing. This information shall not be shared with third parties other than as it relates to customer service and delivery.

2. Waiver

Our failure to exercise or enforce any right or provision of the Terms will not constitute a waiver of such right or provision. A waiver by us of any default will not constitute a waiver of any subsequent default. No waiver by us is effective unless it is communicated to you in writing.

3. Headings

Any headings and titles herein are for convenience only.

4. Severability

If any of the provisions of the Terms are determined by any competent authority to be invalid, unlawful or unenforceable, such provision will to that extent be severed from the remaining Terms, which will continue to be valid and enforceable to the fullest extent permitted by law.

5. Variation

Massage Warehouse may, in its sole discretion, change any of these terms, conditions or policies without notification and it is pointed out that it is your responsibility of the to ensure that they are satisfied with the terms and any changes that may have been affected. In the event where you are not satisfied with any terms or amendments to such terms, the website should no longer be used and no further orders be placed. Using the website after any amendments have been made shall deem your acceptance of such changes.

6. Errors and Omissions

6.1. Whilst all reasonable effort is made to provide accurate information about products (including pricing, availability, features and descriptions), unless proven to be due to gross negligence on our part, Massage Warehouse shall not be held liable for any loss or claim as a result of such error or inaccuracy. We reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time, without prior notice (including after an order has been submitted).

7. Pricing & Stock

7.1. All prices advertised on our website includes VAT of 15%. Prices published on the website applies to in-stock products only. In the event were a specific product may have sold out and an order is placed prior to the possible update of the price, promotion, specification or feature – Massage Warehouse shall inform the customer thereof and should the customer not accept the new offer or specification, Massage Warehouse shall have the right to cancel the order or any part therefor.

8. Delivery of Goods

8.1. Unless otherwise specified, order deliveries shall be done with Massage Warehouse’s contracted third party couriers. Prices advertised on this website shall exclude delivery unless otherwise specified, or where the customer qualifies for free delivery under certain conditions.

8.2. Orders shall be dispatched on the first working day after the clearance of funds in our account. Depending on the size of the order and the exact delivery location, deliver shall generally take around 5-10 days from date of receiving payment. Deliveries are done on weekdays only and within the normal delivery hours of each courier in your particular area. Deliveries to outlying areas such as farms or small towns may take longer. Where a specific area is considered to be a high-risk area by the courier and either not serviced or where delivery fee to this specific area may be higher, Massage Warehouse shall quote the customer the applicable surcharge and where the customer chooses not to accept, Massage Warehouse reserves the right to cancel the order.

8.3. It shall be the customer’s responsibility to properly inspect the goods received. If packaging was visible damages, it is advised to make a clear note of such damages on the waybill when signing for the goods.

8.4. Due to the size and nature of some products, some products may be supplied in knock down format and require self-assembly.

8.5. Customers should ensure that the correct number of cartons as indicated on the waybill is received before signing the waybill. Note that the number of cartons may not correspond to the number of items you have purchased as more than one item may be packaged in a single carton. Only the number of ‘packages’ as indicated on the waybill should be verified before signing for such. Do not sign for two packages if only one is received as this could jeopardize claims against the courier or the insurer and result in the loss being for the customers own account.

8.6. Massage Warehouse only guarantees delivery to the delivery address supplied by customer, but will not verify the identity of the person signing for the goods and therefore cannot guarantee delivery to a specific individual. Any individual present at the delivery address on the date of delivery and accepting the goods shall be considered authorised to receive the delivery on behalf of the customer and responsible to inspect goods in accordance to the terms above.

8.7. Any discrepancies, damages or shortages must be communicated to Massage Warehouse within two business days (weekends excluded) and logged on our Returns section of our website or alternatively by email to customercare@wheco.co.za. It shall be your responsibility to ensure that you receive confirmation of Massage Warehouses receipt of your claim as proof that it has been submitted.

9. Warranty & Returns

9.1. Unless otherwise specified, all Massage Warehouse products comes with a 14-day money-back satisfaction guarantee. This guarantee shall be calculated from the date of delivery of goods.

9.2. The standard warranty on all products shall be 12 (twelve) months unless otherwise specified.

9.3. Warranties shall be valid only where the product was used and maintained properly and shall not cover any defects, damages or claims arising from any misuse or abuse, external causes and factors or what can be considered fair wear and tear. Unless otherwise stated no product shall be covered against any corrosion or damages caused by the natural elements (i.e. rust, wind etc.). Natural variation occurring in wood or other materials are not considered defects neither does the manufacturer guarantee the colour-fastness of any material. This warranty shall also not cover any consequential damages, losses or claims of any kind.

9.4. Customers wanting to return any product purchased from Massage Warehouse must submit a notice of return on the Massage Warehouse website’s ‘returns’ section, or by sending an email to customercare@wheco.co.za.

9.5. Transport charges for products returned for refund or exchange shall be for the account of the customer. Return transport charges may in some cases be higher than the original delivery fees billed, especially where the customer is located in outlying areas and smaller towns, or where original delivery fee has been discounted. Only in cases of warranty claims shall transport charges be borne by Massage Warehouse, and this shall only apply for the first 6 (six) months of the warranty. Products returned for exchange or warranty purposes must be returned to the warehouse that it was originally shipped from. Goods returned must reach Massage Warehouse within 7 (seven) days after the expiry of the 14-day return period.

9.6. Products must be delivered in original packaging where applicable. Even where original package could not be used, it is the customer’s responsibility to ensure products are adequately packaged. In most cases Massage Warehouse utilised the services of third party couriers who does not offer packaging services. Our courier may refuse to accept products without adequate packaging, however in the event where they do collect a product not adequately packaged, it shall be at the risk of the customer. It is advised that customers take adequate photos (covering all areas and angles) of the products they wish to return prior to returning the product as Massage Warehouse will keep the customer liable for any damages to the product when received.

9.7. As soon as a product returned for refund/exchange under the 14-day money back guarantee is received by Massage Warehouse, it shall do a proper inspection of the packaging and the condition of the contents and log any damages or discrepancies. Where the item was returned in perfect, as-new condition a full refund will be paid to the customer, minus the delivery and return transport charges. Massage Warehouse reserves the right to levy reasonable and appropriate surcharges or handling fees to compensate for shortages, damages or re-stocking fees for items not returned in good condition. The exact amount or percentage shall depend on various factors including the overall condition of the item, shortages of parts etc. Refunds shall be made within 10-14 business days from date of receipt of goods by Massage Warehouse.

9.8. Products that were given as free gifts as part of a promotion (i.e. free pillows received with a mattress promotion), received in a competition or give-away or where the product was bought as a shop-soiled or demo product shall not be covered by any warranty.

10. Competitions and Giveaways

10.1. All results for competitions and lucky draws shall be announced solely on the Massage Warehouse official Facebook page on the date published on the competition literature. Winners will not be contacted directly, and as part of the conditions of entry, this is agreed to by the entrant.

10.2. Prizes not claimed by winners within 30 (thirty) days of the results announcement shall be forfeited without exception and may be used by Massage Warehouse.

10.3. Entering a competition does not guarantee any prizes. Winners are randomly chosen and announced. Winners are final and entrants do not have the right to appeal the results. By entering into any of our competitions, the entrant agrees to these terms.

11. Black Friday

All deals are valid while stocks last and is subject to the availability of allocated stock.
Deals shall only be valid for the period advertised.
No laybuy payment plans on sale items will be accepted. Payments must be made immediately via Credit Card or EFT to secure the stock. Processing an order on the website does not automatically reserve stock. Stock can only be reserved when payment has been received.
Unless otherwise stated, all prices exclude delivery fees. Delivery fees will be added as per normal upon checkout.
Delivery of orders shall be handled by contracted third-party couriers and due to the logistical constraints specifically for Black Friday deals may take up to 3 (three) weeks from date of purchase.

12. Gift Cards and Vouchers

12.1  Discount coupons are only valid for the period as published.

12.2  Gift cards that have been purchased from Cielo shall be valid for a period of 3 (three) years from the date of purchase in terms of the Consumer Protection Act. Any voucher issued as part of any promotion or by our customer care department in good faith or as part of any compensation, compromise or resolution for any claim, shall only be valid for a period of 6 (six) months from the date of issue.

12.3 Gift cards may not be exchanged for cash. Customers who purchased a gift card and wishes to cancel the purchase must do so within 7 (seven) days from purchase the date.

12.4 Where a refund or part refund has been approved on a promotional item that included a free voucher, the voucher issued will be cancelled. In the event where this voucher has already been redeemed, the value of such voucher will be deducted from any refund amount due to the client.

12.5 Vouchers linked with promotions, shall only be issued where the full advertised price has been paid. If any discount was offered to the client for the specific product, the free voucher shall no longer apply to the product offer. Cielo reserves the right to exclude laybuy orders from any promotion or clearance sale.
